Can my ex-husband have our marriage annulled without me having to do anything?

We were married in a Congregational Church. After our divorce, he became catholic (got communion and confirmation). He told me he would be having our marriage annulled and that I would have to sign some papers. Nobody ever contacted me about it. I asked him later, and he said I wasn't needed and that he annulled it on his own.


Can he do that or is he lying? I don't really care, just interested.Can my ex-husband have our marriage annulled without me having to do anything?

Annulment is a complicated and hypocritical process, if you ask me, but I believe he is right. Actually, he doesn't even need to be there.





Annulments are carried about by a tribunal of clergy, and they entire thing is done by proxy. What I mean is, a priest represents you, another represents him, they just put forward the ';facts'; of the case and almost always the annulment is granted.





I call it hypocritical because the idea of annulment is sometimes, supposedly rarely, a marriage ceremony takes place between two people who are not legally or morally able to marry, and therefore the marriage is not valid, not really a marriage. But that is very rare--someone who is already married to someone else, or too closely related to the spouse-to-be, or suffering a mental or emotional problem that is keeping them from really seeing what they are getting into. There are both church annulments and civil annulments, btw.





It's hypocritical, though, because the Catholic Church, especially in the USA and Canada, use annulment as a back door divorce. They claim marriage is forever, but then find so many ';defective'; marriages that need to be annulled, and the participants just happen to be divorced and wanting to remarry? The annulment rate is high among American and Canadian Catholics, comparable to the divorce rate among the general population. It's just a rubber stamp, and should be called what it is.





Theoretically you could challenge it if you wanted. That would put a wrinkle in his plans! I don't know how to, but you could call the diocese and ask how to contact a ';canon lawyer';--that's what they call the priests that handle annulments, and see if you could discuss it with him. He can apply for annulment. That doesn't mean it will be granted. If he does apply, you will be given the opportunity to provide input, but will not be required to do so. An annulment is granted or not granted based on the question of whether all requirements for a valid marriage were present at the time you married. That determination is made based on the input from the spouses and sometimes others. If you choose not to provide information, then the determination will be made based upon his input only.
He cannot do that. An annulment requires that you be contacted. Unless he said he couldn't find you, and had no way of contacting you.





I got an annulment and my ex-husband was sent forms to fill out. He was given the same forms I was given and allowed to give his entire view and understanding of our courtship, marriage and divorce.





Either he lied to the Church, or he's lying to you. And that seems very unchristian like.
The annulment would be for him, not you......however, since he became a catholic AFTER the divorce...it makes no difference.





An annulment is a cancellation of the sacrament of marriage...it has nothing to do with a legal marriage. You both did not receive the sacrament of marriage...he has nothing to annul.
He must want to get married to someone else in the church. They frown on divorce. Unless he won the lottery and is trying to pull a fast one, you should let the slug go.
